Washington, D.C. — The American Nuclear Society (ANS), a nonprofit representing over 10,000 professionals in the fields of nuclear science and technology, issued the following statement regarding the U.S. Supreme Court’s decision to grant certiorari to Nuclear Regulatory Commission v. Texas:

“The American Nuclear Society welcomes the Supreme Court’s decision to hear the Nuclear Regulatory Commission’s (NRC) appeal of the U.S. Court of Appeals (5th Circuit) ruling in the matter of a license for the proposed Interim Storage Partners independent spent fuel storage facility in Andrews County, Texas. The ruling by the 5th Circuit called into question the NRC’s authority to regulate nuclear materials in the U.S., upended court precedent, and was at odds with current regulatory practice. It is important to have a stable regulatory environment to enable the use of nuclear energy and nuclear materials for the betterment of people’s health and the planet."
