Holtec files lawsuits over Oyster Creek D&D

Holtec International recently filed two lawsuits against a New Jersey planning board that is attempting to hold up the decontamination and decommissioning of the Oyster Creek nuclear power plant, the Courier Post reported on September 18.

The lawsuits: The lawsuits challenge the Lacey Township Planning Board’s unanimous rejection of Holtec’s application to expand Oyster Creek’s independent spent fuel storage installation. According to the Courier Post, the first lawsuit was filed in U.S. District Court in Trenton and contends that the board’s actions are “preempted by federal law.” The second suit was filed in Ocean County Superior Court and describes the board’s decision as “an active display of bias” against Holtec.

Quote: “By taking this to court, we are seeking to ensure that this activity remains within the purview of the NRC and that it is allowed to move forward,” Holtec spokesman Joe Delmar told the Courier Post.

As the regulating authority, the Nuclear Regulatory Commission has the final say in matters concerning the Oyster Creek nuclear power plant.
